This paper proposes a consistent Crown response to allegations of torture in State care settings outside Lake Alice, including ensuring the appropriate investigation of allegations that cannot be pursued by Police and the treatment of allegations predating New Zealand’s international obligation to investigate torture. It seeks Cabinet agreement to require independent civil investigations of credible torture allegations where criminal investigation is not possible, to apply the policy to pre-1978 allegations, and to authorise ongoing delegated approval of redress for eligible Lake Alice torture survivors in extenuating circumstances.

This paper addresses gaps in how care safety is monitored, enforced and assured across New Zealand's care system, and seeks to establish a more consistent cross-system approach to preventing abuse and neglect in care settings. Cabinet was asked to agree to targeted consultation on options for implementing a cross-system care safety framework, including potential overarching legislation and a statutory duty of care, with detailed proposals to be reported back by April 2027.
